1. Privacy at a GlanceGeneral Information
In accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR), the data controller must inform data subjects about the processing of personal data. This Privacy Policy provides you with information about the processing of personal data.
The following information provides a simple overview of what happens to your personal data when you visit our website or enter into or initiate a business relationship with us. Personal data refers to any data that can be used to personally identify you. For detailed information on data protection, please refer to this Privacy Policy.
As we continue to develop our websites and implement new technologies, changes to this Privacy Policy may be necessary. We therefore recommend that you review this Privacy Policy from time to time. You can always find the current version on this website (www.powervet.at).
Definitions of Terms
For clarity, here are definitions of some important terms used below:
Personal data refers to any data containing information about the personal or factual circumstances of natural persons, such as name, address, email address, phone number, date of birth, age, gender, Social Security number, video recordings, photos, etc. Thus, it includes any information relating to an identified or identifiable natural person (hereinafter “data subject”); A natural person is considered identifiable if they can be identified, directly or indirectly, in particular by association with an identifier such as a name, an identification number, location data, an online identifier, or one or more specific characteristics that reflect the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, distribution, or any other form of disclosure, as well as the alignment or combination, restriction, erasure, or destruction of such data.
Consent means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes, expressed by a statement or other clear affirmative action, by which the data subject indicates that he or she consents to the processing of personal data relating to him or her.
A recipient is a natural or legal person, public authority, agency, or other entity to whom personal data is disclosed, regardless of whether or not that entity is a third party.
A “third party” is a natural or legal person, public authority, agency, or other entity, other than the data subject, the controller, the processor, and the persons authorized to process the personal data under the direct responsibility of the controller or the processor.
The controller is the natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data.
A data processor is a natural or legal person, public authority, agency, or other entity that processes personal data on behalf of the data controller.

If you have any questions regarding this matter, we—as the data controller within the meaning of the GDPR—are available at any time via the contact information provided here to answer your questions or assist you in exercising your rights (see Section 5 of this Privacy Policy):

3. Purposes of Data Processing and RecipientsLegal Basis for Data Processing
Data may be processed only for specific purposes, provided that the processing is based on an appropriate legal basis. Under the General Data Protection Regulation (GDPR), the processing of data is lawful for the following reasons:
The individual has given consent to the processing of personal data concerning him or her for one or more specific purposes (see Article 6(1)(a) of the GDPR)
#The processing is necessary for the performance of a contract to which the data subject is a party or for the implementation of precontractual measures taken at the data subject’s request (see Art. 6(1)(b) of the GDPR).
#The processing is necessary for compliance with a legal obligation to which the controller is subject (see Article 6(1)(c) of the GDPR).
#The processing is necessary to protect the vital interests of the data subject or another natural person (see Article 6(1)(d) of the GDPR).
#The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller (see Article 6(1)(e) of the GDPR).
The processing is necessary to safeguard the legitimate interests of the controller or a third party, unless the interests or fundamental rights and freedoms of the data subject that require the protection of personal data take precedence, particularly if the data subject is a child (see Art. 6(1)(f) of the GDPR)
Purposes of Our Processing of Your Data
Your data is collected, first and foremost, when you provide it to us. We collect your contact information (name, academic title, date of birth, address, email address, phone number). This data is necessary for using our services and for entering into a contract, and is collected and processed when you contact us (e.g., via email, by filling out the contact form on our website, when filling out a registration form for our training program, or when subscribing to our newsletter). The legal basis for the data processing is Article 6(1)(a) and (b) of the GDPR.
If you submit inquiries to us via the contact form or by other means (e.g., email, phone, mail, social media), we will store the information provided in your inquiry or on the inquiry form—including the contact information you provided there—for the purpose of processing your inquiry and in case of follow-up questions. We will not share this data without your consent.
The processing of data entered or provided in the contact form or through an inquiry submitted by other means is therefore based exclusively on your consent (Art. 6(1)(a) GDPR). You may revoke this consent at any time. To do so, simply send us an informal email. The lawfulness of the data processing operations carried out prior to the withdrawal remains unaffected by the withdrawal.
The data you enter in the contact form or otherwise provide to us in writing will remain with us until you request that we delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies (e.g., after your inquiry has been processed or the contractual relationship has ended). Mandatory legal provisions—in particular retention periods—remain unaffected.
Other data is automatically collected by our IT systems when you visit the website. This consists primarily of technical data (e.g., IP address, web browser, operating system, number and duration of sessions, time of page view, device type, browser language, geographic location data, source of web access). This data is collected as soon as you visit our website. This general data and information is stored in the server’s log files. The collection of this data is necessary to ensure that the website you have accessed is displayed correctly. The legal basis for the data processing is Article 6(1)(f) of the GDPR.
Photographs and videos are taken at our events (e.g., lectures, seminars), and you, as a participant, may be depicted in them. By participating in one of our events, you explicitly consent—by signing the registration form for the respective event, which we provide to you—to the processing (collection and possible publication on our website, on our social media channels, and in our company’s printed materials) of personal data (photos, videos) resulting from your participation. The processing of this data is based, in part, on your consent. The legal basis for the data processing is Article 6(1)(a) of the GDPR. Furthermore, the processing of this data is also based in part on our legitimate interest in documentation. In such cases, the legal basis for the data processing is Article 6(1)(f) of the GDPR.

We intend to transfer the data to the following third countries:

In its decision dated July 10, 2023, C(2023) 4745 final, the European Commission determined that the United States of America provides an adequate level of data protection within the meaning of Article 45 of the GDPR if our contractual partner is included in the EU-U.S. Privacy Shield list. You can find information regarding the registration of individual providers on this list in the respective section of this Privacy Policy.
In the absence of an adequacy decision, we may only transfer data on the basis of appropriate safeguards, such as standard contractual clauses, binding internal data protection policies, approved codes of conduct, approved certification mechanisms, etc. A transfer may nevertheless be permitted under the conditions set forth in Article 49 of the GDPR. We will be happy to provide you with a copy of these safeguards for your specific case upon request.
There is no intention to transfer the data to an international organization.
4. Retention PeriodData is generally stored only for as long as required by statutory retention obligations. 9. Your Rights / Legal Notice 9.1 Right of Access under Article 15 of the GDPR As a data subject, you have the right to request confirmation from the controller as to whether personal data concerning you is being processed; if so, you have the right to access that personal data and to receive the following information:
- the purposes of processing
- the categories of personal data that are processed
- the categories of personal data that are processed
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
- if possible, the planned period for which the personal data will be stored, or, if this is not possible, the criteria used to determine that period
- the existence of a right to have personal data concerning them rectified or erased, or to have the processing restricted by the controller, or a right to object to such processing
- the existence of a right to file a complaint with a supervisory authority
- if the personal data is not collected from the data subject, all available information regarding the origin of the data
- the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR; and—at least in such cases—meaningful information regarding the logic involved, as well as the scope and intended consequences of such processing for the data subject.
9.2. Right to Rectification under Article 16 of the GDPRAs a data subject, you have the right to request that the controller promptly rectify any inaccurate personal data concerning you. Taking into account the purposes of the processing, you also have the right to request that incomplete personal data be completed.
9.3. Right to erasure under Article 17 of the GDPRAs a data subject, you have the right to request that the controller delete personal data concerning you without delay. The controller is then obligated to delete the personal data without delay if any of the following grounds apply:
- The personal data is no longer necessary for the purposes for which it was collected or otherwise processed.
- You withdraw your consent on which the processing was based pursuant to Article 6(1)(a) or Article 9(2)(a) of the GDPR, and there is no other legal basis for the processing.
- You object to the processing pursuant to Article 21(1) of the GDPR, and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) of the GDPR.
- The personal data was processed unlawfully.
- The erasure of personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
- The personal data was collected in connection with the information society services offered, in accordance with Article 8(1) of the GDPR.
The right to erasure does not apply to the extent that the processing of the data is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation that requires processing under Union or Member State law to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, for reasons of public interest in the area of public health pursuant to Article#nbspsp;9(2)(h) and (i) of the GDPR, as well as Article 9(3) of the GDPR; for archiving purposes in the public interest, scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the GDPR; to the extent that the right referred to in paragraph 1 is likely to render impossible or seriously impair the achievement of the objectives of such processing, or to the assertion, exercise, or defense of legal claims.
9.4. Right to Restriction of Processing under Article 18 of the GDPRAs a data subject, you have the right to request that the controller restrict processing if any of the following conditions are met:
- The data subject disputes the accuracy of the personal data for a period of time that allows the controller to verify the accuracy of the personal data.
- The processing is unlawful; the data subject objects to the erasure of the personal data and instead requests that the use of the personal data be restricted.
- The controller no longer needs the personal data for the purposes of processing, but the data subject needs it to assert, exercise, or defend legal claims.
- The data subject has objected to the processing pursuant to Article 21(1) of the GDPR, and it has not yet been determined whether the controller’s legitimate interests outweigh those of the data subject.
If processing has been restricted in this manner, such personal data—with the exception of its storage—may be processed only with the consent of the data subject, or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of a substantial public interest of the Union or a Member State.
9.5. Right to Object Under Article 21 of the GDPRAs a data subject, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you that is carried out pursuant to Article 6(1)(e) or (f) of the GDPR. This also applies to profiling based on these provisions. The controller will no longer process the personal data unless it can demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or the processing is necessary for the establishment, exercise, or defense of legal claims.
If personal data is processed for the purpose of direct marketing, you, as the data subject, have the right to object at any time to the processing of your personal data for the purpose of such marketing. This also applies to profiling, to the extent that it is related to such direct marketing.
9.6. Right to Data Portability under Article 20 of the GDPRAs a data subject, you have the right to receive the personal data concerning you that you have provided to a controller in a structured, commonly used, and machine-readable format, and you have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR, or on a contract pursuant to Article 6(1)(b) of the GDPR, and the processing is carried out by automated means.
When exercising your right to data portability as described herein, you, as the data subject, have the right to have your personal data transferred directly from one data controller to another, to the extent that this is technically feasible.
9.7. Right to Withdraw Consent at Any TimeIf the data processing is based on your consent pursuant to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR, you, as the data subject, have the right to withdraw your consent at any time. This does not affect the lawfulness of the processing carried out on the basis of your consent prior to its withdrawal.
9.8.To exercise these rights, you may contact the data controller (see also Section 2 of this Privacy Policy) using the following contact information:

You are generally not obligated to provide this data. However, in order to enter into a contract, it is essential that the data subject provide us with personal data. If you do not provide the data, it is unfortunately not possible to enter into a contract.
11.2.We do not use automated decision-making, including profiling, as defined in Article 22, paragraphs 1 and 4, of the GDPR.
